4. Service Description and Scheduling

4.1 Repair Services

Gorikaya-Grusha provides professional repair services for residential and commercial properties as described on our Site. Services are subject to availability, local regulations, and technical feasibility.

4.2 Scheduling and Appointments

When scheduling a service appointment, you agree to provide accurate information regarding the service location and repair needs. We will make reasonable efforts to arrive within the scheduled timeframe, but exact appointment times cannot be guaranteed due to the variable nature of repair work.

4.3 Service Area

Our services are available within our designated service area in Canada. Additional fees may apply for locations outside our primary service area. We reserve the right to decline service to locations we cannot reasonably service.

4.4 Cancellation Policy

If you need to cancel or reschedule a service appointment, please provide at least 24 hours' notice. Late cancellations or missed appointments may result in a cancellation fee.

5. Fees and Payment

5.1 Service Fees

Our service fees are based on the type of repair, time, materials, and complexity of the job. We will provide a quote before beginning any work. In some cases, additional charges may apply if unexpected issues are discovered during the repair process, but we will always discuss these with you before proceeding.

5.2 Payment Terms

Payment is due upon completion of service unless other arrangements have been made in advance. We accept various payment methods as indicated on our Site and during the booking process.

5.3 Quotes and Estimates

Quotes provided are valid for 30 days unless otherwise specified. Estimates are provided in good faith based on visible and known factors, but may change if additional issues are discovered during the repair process.

6. Warranties and Service Guarantees

6.1 Workmanship Warranty

We provide a 90-day warranty on our labor and workmanship. This warranty covers issues directly related to the work we performed, but does not cover problems arising from normal wear and tear, misuse, or unrelated factors.

6.2 Materials and Parts

Manufacturer warranties apply to materials and parts used in repairs. We will assist you in processing any warranty claims for defective materials or parts.

6.3 Limitations

Our warranties and guarantees do not cover damages resulting from acts of nature, accidents, misuse, neglect, unauthorized modifications, or failure to follow care instructions.

7. User Content

When you submit content to our Site (such as reviews, comments, or testimonials), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that you own or control all rights to the content you post, that the content is accurate, and that use of the content does not violate these Terms or any applicable laws.

8. Intellectual Property Rights

The Site and its entire content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Gorikaya-Grusha, its licensors, or other providers of such material and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as incidental to normal web browsing.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Gorikaya-Grusha and its affiliates, employees, directors, officers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the services
• Any conduct or content of any third party on the services
• Any content obtained from the services
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all claims exceed the amount paid by you, if any, for using our services during the six (6) months prior to the date of the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Gorikaya-Grusha, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site or services.

11. Governing Law and Jurisdiction

These Terms and your use of the Site and services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law principles.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the courts located in Toronto, Ontario, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant jurisdiction.

12. Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

13. Entire Agreement

These Terms, our Privacy Policy, and any applicable service agreements constitute the sole and entire agreement between you and Gorikaya-Grusha regarding the Site and services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
